2. QUOTATIONS, PRICING AND TAXES
The prices of photography and related services are determined individually for each assignment.
The applicable price may depend on, among other things:

No price appearing in previous correspondence, previous projects, examples, historical quotations or other documents shall automatically apply to a new assignment unless expressly confirmed in writing.
A personalised quotation / devis may be provided to the Client before the booking is confirmed.
The quotation may specify:
- the total project fee;

- the deposit required;
- the remaining balance;
- services included;
- number and type of deliverables;
- shooting duration;
- delivery schedule;
- retouching;
- usage and licensing rights;
- additional expenses;
- and any other project-specific conditions.
Once accepted by the Client, the quotation forms part of the agreement between the Photographer and the Client and establishes the price and scope applicable to that specific assignment.
In the event of a discrepancy between these general Terms and a specific written quotation or contract, the specific quotation or contract shall prevail with respect to the relevant assignment.
All amounts are expressed in euros (€).
Where French VAT (TVA) is applicable, it shall be charged at the legally applicable rate.
Where the Photographer benefits from a VAT exemption under the applicable French tax regime, the relevant invoice will state:
“TVA non applicable, art. 293 B du CGI.”
Any additional service, expense, image, retouching, overtime, travel, equipment, location, production cost or usage right not expressly included in the accepted quotation may be invoiced separately.
3. BOOKING AND CONFIRMATION
A booking is considered confirmed only when the conditions specified in the applicable quotation, contract or booking confirmation have been satisfied.
Unless otherwise expressly agreed in writing, a 50% deposit of the total agreed project fee is required to secure the booking and reserve the agreed date.
The booking remains unconfirmed until the required deposit has been received.
For certain services, including model tests or other assignments expressly identified by the Photographer, different payment arrangements may apply. Such arrangements will be confirmed in writing before the service.
The Photographer reserves the right to decline or refuse a booking at their discretion, subject to applicable law.
4. PAYMENT TERMS
Unless otherwise agreed in writing:
- 50% of the agreed project fee is payable as a deposit to confirm the booking;
- the remaining 50% is payable before or on the day of the shoot;
- the applicable payment deadlines will be stated on the quotation and/or invoice.
For certain commercial assignments, agencies, brands or other professional Clients, alternative payment terms may be agreed in writing.
Any agreed payment deadline must be respected.
Invoices shall be paid using the payment method specified on the invoice, quotation or contract.
Where legally applicable, late-payment penalties and any legally prescribed fixed compensation for recovery costs may be charged in accordance with French law.
For professional Clients, the applicable provisions of the French Commercial Code concerning late payment shall apply.
Failure to make a required payment may result in the suspension, postponement or cancellation of the assignment and/or withholding of delivery until payment has been received, subject to applicable law.
5. INVOICING
An invoice will be issued for the applicable services and payments.
The invoice will specify the amount due, applicable taxes or VAT exemption, payment deadline and other legally required information.
Where a deposit is required, the deposit invoice may indicate both:
- the total agreed project fee; and
- the amount of the deposit currently payable.
The remaining balance will be invoiced according to the agreed payment schedule.
The invoice, together with the accepted quotation, booking confirmation, contract and applicable Terms, may constitute evidence of the contractual relationship and agreed payment obligations, subject to applicable law.
6. TRAVEL, ACCOMMODATION, LOCATIONS AND THIRD-PARTY COSTS
Unless expressly included in the quotation, the Client is responsible for costs associated with:
- travel;
- transportation;
- accommodation;

- and other third-party services required for the assignment.
Where such expenses are known in advance, they may be included in the quotation.
Where additional costs arise during the project, they will be communicated to the Client where reasonably possible and may be invoiced separately.
The Client is responsible for ensuring that the Photographer has lawful and timely access to the agreed location.
7. SHOOT DURATION AND OVERTIME
The duration of each assignment is determined by the accepted quotation or contract.
Any additional shooting time requested by the Client beyond the agreed duration may be charged separately.
For full-day assignments, the agreed working day includes reasonable breaks and setup time as specified in the quotation.
Overtime charges, where applicable, will be specified in the quotation or agreed in writing before the additional work is undertaken whenever reasonably possible.
The Photographer is not required to continue working beyond the agreed duration without appropriate compensation.
8. RETOUCHING AND POST-PRODUCTION
The level of retouching included in each assignment will be specified in the quotation or contract.
Unless otherwise agreed:
Basic retouching may include:
- colour correction;
- exposure and tonal adjustments;

Advanced retouching may include:
- extensive skin retouching;
- body reshaping;

- background replacement;
- compositing;
- complex manipulation;

Advanced retouching is not included unless expressly stated in the quotation and may be charged separately.
For commercial fashion, catalog, campaign, e-commerce and advertising assignments, the scope of retouching will be agreed separately according to the requirements of the project.
The Photographer retains artistic and creative control over the final editing of the images unless specific editing instructions have been agreed in writing.
9. IMAGE SELECTION
Where a selection process is included, the Client may be provided with a preview gallery or proofing gallery.
The method of selection will depend on the type of assignment.
Unless otherwise agreed, the Photographer may determine the final selection for services such as model tests, editorial work or other assignments where artistic selection is part of the service.
Unselected images are not included in the final delivery unless expressly agreed.
10. DELIVERY OF PHOTOGRAPHS
The number of final images and the delivery deadline will be specified in the quotation or contract.
Unless otherwise agreed, final images will be delivered electronically using a downloadable link, online gallery or another digital delivery method selected by the Photographer.
Delivery deadlines depend on:
- the type of assignment;
- number of images;
- retouching requirements;
- Client selections;
- project complexity;
- and any agreed expedited delivery.
The Client is responsible for downloading and safely storing the delivered files.
The Photographer is not responsible for the loss of files after the Client has received the final delivery.
The Photographer may retain archived copies of the delivered images for professional and legal purposes but does not guarantee permanent storage.
11. EXPEDITED DELIVERY
If the Client requires delivery within a shorter period than the standard delivery schedule, expedited processing may be available subject to the Photographer’s availability.
Any expedited delivery fee or surcharge will be agreed in writing before the expedited work begins.
The Photographer does not guarantee expedited delivery unless it has been expressly confirmed in writing.
12. RAW AND ORIGINAL FILES
RAW, unedited or original camera files are not included in the standard delivery.
The Photographer retains the original RAW files and full creative control over the editing process.
RAW or unedited files may only be supplied if expressly agreed in writing and may be subject to an additional fee and specific conditions.
The Client may not assume that the delivery of edited photographs includes RAW or unedited files.
13. COPYRIGHT AND INTELLECTUAL PROPERTY
Unless otherwise agreed in writing, the Photographer retains the copyright and intellectual property rights in the photographs created during the assignment.
The purchase of photography services does not automatically transfer copyright ownership to the Client.
The Client receives only the usage rights expressly granted in the quotation, contract or other written agreement.
Any rights not expressly granted remain with the Photographer.
14. CLIENT USAGE RIGHTS
The permitted use of the photographs depends on the type of assignment and the rights specified in the applicable quotation or contract.
For personal photography, the Client may receive a personal, non-commercial licence to use the final photographs for personal purposes such as:
- personal social media;
- personal websites;
- personal portfolios;
- private printing;
- personal albums;
- and personal sharing.
For commercial assignments, the Client receives only the commercial usage rights expressly specified in the agreement.
Commercial usage may include, depending on the agreement:
- websites;
- social media;
- e-commerce;
- catalogues;
- advertising;
- editorial publications;
- promotional materials;
- paid media;
- print campaigns;
- outdoor advertising;
- or other specified media.
The duration, territory, media, exclusivity and purpose of commercial usage may be limited according to the agreement.
Any use outside the agreed licence requires the Photographer’s prior written consent and may require an additional licensing fee.
15. EXCLUSIVITY AND EXTENDED LICENSING
Exclusive rights are not included unless expressly stated in writing.
If the Client requires exclusive usage, exclusivity, buyout rights, transfer of copyright, unlimited commercial usage or other extended rights, these terms must be expressly agreed before the relevant use begins.
Additional fees may apply depending on:
- territory;
- duration;
- media;
- campaign size;
- advertising budget;
- exclusivity;
- distribution;
- and intended commercial use.
16. PHOTOGRAPHER’S PORTFOLIO AND PROMOTIONAL USE
Unless otherwise agreed in writing, the Photographer may use photographs created during an assignment for:
- portfolio purposes;
- website;
- social media;
- exhibitions;
- editorial promotion;
- professional presentations;
- awards and competitions;
- self-promotion;
- and other promotional activities.
For commercial, advertising, confidential or unreleased campaigns, the Client may request confidentiality or restrictions on promotional use.
Any confidentiality or embargo requirement should be agreed in writing before the assignment.
Where the Client requires the images to remain completely private and prohibits portfolio or promotional use, the terms may be subject to a separate agreement.
17. MODEL RELEASES AND THIRD-PARTY RIGHTS
Where models, performers or other identifiable persons are involved, the necessary releases and permissions shall be arranged by the party responsible for engaging such persons, unless otherwise agreed.
For commercial projects, the Client is responsible for ensuring that all necessary rights and permissions relating to:
- models;
- talent;
- locations;
- brands;
- logos;
- artwork;
- products;
- trademarks;
- and other third-party materials
have been obtained where required.
The Photographer may assist with arranging models or other professionals, but all associated costs shall be agreed separately.
18. CLIENT RESPONSIBILITIES
The Client agrees to provide all information, materials, products, clothing, references, brand guidelines, schedules and other items reasonably required for the assignment.
For commercial projects, the Client should provide a sufficiently detailed brief before the shoot.
The Client is responsible for ensuring that products and materials supplied for photography are clean, functional and suitable for the assignment.
The Client must inform the Photographer in advance of any special requirements, restrictions, deadlines, confidentiality requirements or intended usage.
Delays caused by the Client may affect the shooting schedule, delivery date or additional costs.
19. CANCELLATION BY THE CLIENT
Cancellation terms will depend on the nature of the assignment and the date of cancellation.
Unless otherwise specified in the quotation or contract, the Photographer may retain the deposit when the Client cancels a confirmed booking within the period specified in the applicable cancellation policy.
For cancellations made at very short notice, the Photographer may charge an additional cancellation fee corresponding to work already undertaken, expenses incurred and/or the agreed cancellation terms.
Where the Client cancels after substantial preparation, production, travel arrangements, location bookings, casting or other expenses have been incurred, such costs may remain payable.
The specific cancellation terms stated in an accepted quotation or contract shall prevail.
20. NO-SHOW
If the Client fails to appear for a confirmed shoot without reasonable prior notice, the booking may be treated as a cancellation by the Client.
The Photographer may retain the deposit and/or charge the applicable cancellation fee according to the agreed cancellation terms.
Any costs already incurred for the assignment may also remain payable where legally permitted.
21. RESCHEDULING
Requests to reschedule must be made as early as reasonably possible.
Rescheduling is subject to the Photographer’s availability.
A deposit may be transferred to a new date where the rescheduling is accepted by the Photographer.
If a request to reschedule is made at very short notice, the Photographer may treat it as a cancellation and apply the applicable cancellation terms.
Any new date must be confirmed in writing.
22. WEDDING PHOTOGRAPHY
Wedding photography is subject to the specific quotation and wedding agreement provided to the Client.
The quotation will specify, as applicable:
- coverage duration;
- number of photographers;
- number of final images;
- delivery timeframe;
- album or print products;
- engagement sessions;
- additional hours;
- travel;
- accommodation;
- and usage rights.
Unless otherwise agreed, wedding bookings require a deposit to reserve the date.
The remaining balance is payable according to the payment schedule stated in the wedding quotation or contract.
Because a wedding date is reserved exclusively for the Client, cancellation terms may differ from those applicable to other photography services.
In the event that the Photographer becomes unable to attend the wedding due to serious illness, emergency or another exceptional circumstance, the Photographer will make reasonable efforts to provide a replacement photographer of an appropriate professional standard, subject to the Client’s approval, or provide the applicable refund where a suitable replacement cannot be arranged.
23. EVENT PHOTOGRAPHY
Event photography may include:
- corporate events;
- conferences;
- private celebrations;
- brand activations;
- parties;
- launches;
- performances;
- and other events.
The exact coverage duration, deliverables, delivery schedule and usage rights will be specified in the quotation.
The Client is responsible for providing the Photographer with relevant event schedules, access information, restrictions and key moments that should be prioritised.
The Photographer will make reasonable efforts to capture the important moments identified by the Client but cannot guarantee the capture of every individual, moment or event detail.
24. CATALOG, E-COMMERCE AND PRODUCT PHOTOGRAPHY
For catalog, e-commerce and product assignments, the Client must provide products in suitable condition for photography.
Products should be:
- clean;
- undamaged;
- properly prepared;
- correctly labelled;
- and delivered on time.
Where multiple colours, sizes, models or variations are required, these must be organised and identified before the shoot.
The quotation will determine the number of products, images, angles, variations and retouching included.
Additional products, variations, images or retouching may require additional fees.
The Client is responsible for providing accurate product information and ensuring that the Photographer has the necessary rights to photograph and publish the products.
25. LOOKBOOK AND FASHION PHOTOGRAPHY
Lookbook and fashion assignments are individually tailored according to:
- number of looks;
- models;
- locations;
- shooting duration;
- creative direction;

Campaign and advertising assignments require a detailed written brief.
The Client should provide information concerning:
- campaign objectives;
- intended audience;
- products or services;
- required deliverables;

The exact number of images, shooting duration, retouching and permitted usage will be specified in the quotation.
The Client may not assume that social media usage automatically includes paid advertising, third-party licensing, print advertising, outdoor advertising or other commercial uses unless expressly stated.
28. PRINTING AND PHYSICAL PRODUCTS
Printing, albums, framed photographs, fine-art prints and other physical products are not included unless expressly stated in the quotation.
Printing and production costs will be charged separately where applicable.
The Photographer is not responsible for colour differences caused by:
- Client monitors;
- screen settings;
- third-party printers;
- paper types;
- or other technical factors outside the Photographer’s control.
29. CONFIDENTIALITY
Where confidentiality is required, the Client should communicate the requirement before the assignment.
Confidentiality obligations may include restrictions on:
- publication;
- portfolio use;
- social media;
- advertising;
- disclosure of campaign information;
- or delivery of materials.
Specific confidentiality requirements may be documented in a separate agreement or included in the quotation or contract.
30. FORCE MAJEURE
Neither party shall be considered responsible for failure or delay in performing contractual obligations where such failure or delay results from circumstances beyond reasonable control.
Such circumstances may include, where applicable:
- natural disasters;
- extreme weather;
- government restrictions;
- travel restrictions;
- serious illness;
- accidents;
- strikes;
- major technical failures;
- transport disruption;
- or other exceptional circumstances that make performance impossible or unreasonable.
The affected party shall notify the other party as soon as reasonably possible.
Where possible, the parties will attempt to reschedule the assignment.
The treatment of deposits, payments and expenses in a force majeure situation will depend on the circumstances and applicable law, as well as the specific terms agreed for the assignment.
31. PHOTOGRAPHER’S ILLNESS OR UNAVAILABILITY
If the Photographer is unable to perform the assignment due to serious illness, emergency or another exceptional circumstance, the Photographer will make reasonable efforts to:
- reschedule the assignment;
- provide a suitable replacement photographer where appropriate and acceptable to the Client; or
- refund payments received for services that cannot be provided, subject to applicable law and the specific contractual circumstances.
The Photographer shall not be liable for indirect losses, consequential damages, loss of profits or other expenses arising from circumstances beyond the Photographer’s reasonable control, to the extent permitted by law.
32. LIMITATION OF LIABILITY
The Photographer will perform the services with reasonable professional care.
The Photographer shall not be responsible for circumstances outside their reasonable control, including:
- venue restrictions;
- guest interference;
- weather;
- traffic;
- delays caused by the Client or third parties;
- inaccessible locations;
- failure of third parties;
- or other circumstances that materially affect the assignment.
In the event of technical failure or loss of images caused by circumstances beyond the Photographer’s reasonable control, the Photographer will make reasonable efforts to recover or reproduce the affected work where possible.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
33. CREATIVE STYLE
The Client acknowledges that photography is a creative service and that the Photographer’s artistic style forms an important part of the service.
The Photographer retains creative control over:
- composition;
- lighting;
- colour;
- editing;
- retouching;
- image selection;
- and final artistic presentation,
unless specific requirements have been expressly agreed in writing.
References or mood boards supplied by the Client are intended as creative guidance and do not guarantee an identical result.
34. DELIVERY ACCEPTANCE AND ADDITIONAL REQUESTS
The final delivery corresponds to the services and deliverables specified in the accepted quotation.
Requests for additional images, additional retouching, alternative edits, new formats or other work outside the agreed scope may be charged separately.
Unless otherwise agreed, the Client may not require unlimited revisions to completed photographic work.
Any additional post-production must be agreed before the additional work is performed.
35. CLIENT COMPLAINTS
Any complaint concerning the delivered services or images should be communicated to the Photographer in writing as soon as reasonably possible after delivery.
The Client should provide sufficient information to allow the Photographer to investigate the complaint.
Where an issue is attributable to the Photographer and can reasonably be corrected, the Photographer may, at their discretion and subject to the agreement, provide a correction or reasonable remedy.
36. AGREEMENT BETWEEN THE PARTIES
The contractual relationship may consist of:
- these Terms and Conditions;
- the accepted quotation / devis;
- the signed contract, where applicable;
- the booking confirmation;

The specific quotation or contract determines the project-specific elements, including price, deliverables, schedule and usage rights.
The Client is responsible for reviewing all applicable documents before confirming the booking.
37. CHANGES TO THE TERMS
The Photographer reserves the right to update these Terms from time to time.
The version applicable to a particular assignment shall be the version provided to or made available to the Client at the time the booking is confirmed, subject to applicable law.
Changes made after confirmation of a booking shall not retroactively modify the agreed terms of that assignment unless otherwise agreed by the parties or required by law.
38. GOVERNING LAW AND JURISDICTION
These Terms are governed by French law.
Where the Client is a professional, disputes shall, where legally permitted, be subject to the jurisdiction agreed in the applicable contract or, in the absence of such agreement, the competent French courts.

Nothing in these Terms is intended to deprive a consumer of any mandatory right granted by applicable law.
39. AGREEMENT TO THESE TERMS
